Reclusion perpetua for abaca stripper who raped, killed lesbian drinking pal

A 20-year old abaca stripper from Caramoran has been sentenced to reclusion perpetua without eligibility for parole after being found guilty of rape with homicide by the Regional Trial Court last week.

RTC Branch 42 Presiding Judge Genie G. Gapas-Agbada anchored the guilty verdict on circumstantial evidence and the fact that, in the presence of his friends, Jonel Luceña Solero admitted to an Army soldier that he raped and killed the victim.

Solero was also ordered to pay the heirs of the victim, Sheena Joy Zuniega a total of P350,000 in civil indemnity, moral, exemplary and temperate damages.

During the trial, it was determined that the two are relatives, as the grandfather of Solero’s father and the grandfather of Zuniega’s mother are siblings.

The Court established that at about 7:30 P.M. of Feb. 4, 2018, Solero had a drinking spree at Melvin Solmiano’s residence in barangay Obi together with some of their neighbors and friends: Jimboy Dequiroz, Mark Philip Lucero and Joseph Toquero.

At around 9 P.M., Sheena Joy, together with Joseph Pantila, arrived and joined the drinking spree, but the latter left after 30 minutes.

At 10 P.M., she told the group that she would just urinate at the back of the house. After a while, Solero also went out without telling them where he would go.

Melvin Solmiano Sr. later told the group that he saw Sheena Joy and Jonel leaving and sharing an umbrella.

At around 1 A.M. of Feb. 5, Solero went to the house of Jimboy where he slept over together with Mark Philip and Joseph as they previously agreed upon.

Sometime at noon, Solero’s stepfather found the body of Sheena Joy, then just 20, in front of a nipa hut owned by the suspect’s family. Without pants and underwear, the victim’s body sustained a wound and fracture in the head as well as a stab wound at the left side of the body that police said caused her instantaneous death. Also found at the crime scene was a broken bottle with bloodstains that was apparently used to kill the victim.

At 6:18 P.M. later that night, as the police were conducting an investigation, Jonel voluntarily surrendered to Cpl. Ianjo Ponferrada at the Iyao detachment of the Echo company of the Philippine Army where he admitted to the crime in the presence of his friends Jimboy, Mark Philip and Joseph.
